TERMS OF SERVICE

These Terms of Service govern your use of the Clear Lens Real Estate Photography website and services. By accessing our website, booking an appointment, purchasing services, or using media produced by Clear Lens Real Estate Photography, you agree to these Terms.

  1. SERVICES

Clear Lens Real Estate Photography provides real estate media and marketing services, including:

• Real estate photography
• HDR and flash photography
• Video tours and social media reels
• Drone photography and video
• Zillow 3D virtual tours
• Floor plan drawings
• Virtual twilight images
• Property-line graphics
• Agent branding and on-camera content
• Social media and property-marketing materials

Services are provided according to the selections made at booking, property conditions, weather, equipment availability, applicable laws, and any written arrangements made with Clear Lens Real Estate Photography.

  1. BOOKING AND SCHEDULING

Appointments must be booked in advance and are subject to availability.

The client is responsible for providing accurate property information, contact information, service selections, access instructions, and appointment details.

The property must be cleaned, staged, accessible, and ready to photograph at the scheduled appointment time. Clear Lens Real Estate Photography team members are not responsible for cleaning, staging, moving furniture, handling personal belongings, or preparing the property.

The client is responsible for obtaining permission from the property owner or other authorized party for Clear Lens Real Estate Photography to enter the property and perform the requested services.

Clear Lens Real Estate Photography may reschedule or modify an appointment because of weather, unsafe conditions, access problems, illness, equipment issues, airspace restrictions, or other circumstances beyond our reasonable control.

  1. CANCELLATIONS, RESCHEDULING, AND ACCESS

Cancellations or rescheduling requests should be submitted at least 48 hours before the scheduled appointment.

Cancellations, rescheduling requests, denied access, or properties that are not ready within 48 hours of the appointment may result in a fee of up to 100% of the scheduled order total.

Additional fees may apply if our team must wait for access, return to the property, photograph areas that were unavailable during the original appointment, or perform additional work not included in the original order.

  1. PROPERTY CONDITION

Clear Lens Real Estate Photography photographs properties substantially as they appear when our team arrives.

Although team members may make minor adjustments when practical, we do not guarantee that items will be moved, hidden, cleaned, repaired, staged, or digitally removed.

The client is responsible for securing valuables, confidential information, medications, firearms, pets, and other sensitive or hazardous items before the appointment.

Clear Lens Real Estate Photography may refuse to enter or continue working in any property or area that presents an unsafe, unsanitary, unlawful, threatening, or hazardous condition.

  1. DRONE SERVICES

Drone services are subject to weather, visibility, airspace restrictions, property conditions, Federal Aviation Administration requirements, pilot judgment, and operational safety.

If drone operations cannot be performed safely or legally during the scheduled appointment, Clear Lens Real Estate Photography may reschedule the drone portion, offer an appropriate alternative, or remove the unavailable service from the order.

No specific altitude, angle, flight path, image, or video clip is guaranteed.

  1. FLOOR PLANS, PROPERTY LINES, AND REPRESENTATIONS

Floor plans, room dimensions, square-footage estimates, property-line graphics, virtual staging, and related materials are provided for general marketing and illustrative purposes only.

Measurements and boundaries are approximate and should not be used for construction, appraisal, legal, surveying, or engineering purposes.

Property-line graphics are not surveys and do not establish legal property boundaries. Clients should consult a licensed surveyor or other qualified professional when exact boundaries or measurements are required.

  1. DELIVERY AND TURNAROUND TIMES

Estimated turnaround times are not guarantees. Delivery times may vary because of order size, requested services, revisions, weather, holidays, technical issues, third-party processing, or circumstances beyond our reasonable control.

Different portions of an order may be delivered separately. Photography and floor plans may be delivered before video, virtual staging, property-line graphics, or other specialized products.

Clear Lens Real Estate Photography is not responsible for delays caused by third-party platforms, internet outages, hosting services, editing providers, MLS systems, Zillow, social networks, or other external services.

  1. PAYMENT

Payment is due according to the terms shown during booking or invoicing. Unless otherwise arranged in writing, final media may be withheld until payment is received.

The client authorizes Clear Lens Real Estate Photography and its payment providers to process the charges associated with the order.

Additional services, return visits, rush requests, extensive revisions, travel, access delays, or changes outside the original order may result in additional charges.

Past-due balances may result in suspended service, restricted downloads, revoked usage permission, collection activity, or refusal of future bookings.

  1. COPYRIGHT AND LICENSE

Clear Lens Real Estate Photography retains the copyright and ownership of all photographs, videos, designs, and other media it creates unless otherwise agreed in writing.

After payment, the client receives a limited, non-exclusive, non-transferable license to use the delivered media to market the property and the client’s associated real estate services.

Media may not be sold, transferred, sublicensed, distributed, or provided to another agent, brokerage, builder, homeowner, vendor, publication, or third party without written permission from Clear Lens Real Estate Photography.

This license does not transfer copyright ownership.

  1. MEDIA USAGE AND RESTRICTIONS

Delivered media may be used for the marketing and sale or lease of the property for which it was created, as well as for the client’s related professional marketing, subject to any restrictions communicated by Clear Lens Real Estate Photography.

Media may not be materially altered, manipulated, filtered, or edited in a misleading or damaging manner.

The client is responsible for ensuring that their use of the media complies with MLS rules, advertising regulations, brokerage policies, fair-housing requirements, platform rules, and applicable laws.

Unless the client requests otherwise in writing before the appointment, Clear Lens Real Estate Photography may display completed media in its portfolio, website, social media, advertising, demonstrations, competitions, and promotional materials.

  1. REVISIONS

Requests to correct a technical error or omission should be submitted promptly after delivery.

Changes resulting from information supplied by the client, changed preferences, newly staged areas, unavailable rooms, weather, property changes, or services outside the original order may require additional payment.

Clear Lens Real Estate Photography retains reasonable creative discretion regarding composition, lighting, editing, color, music, pacing, image selection, and final presentation.

  1. THIRD-PARTY SERVICES

Some services depend on third-party platforms and providers, including Aryeo, Zillow, CubiCasa, Google, Meta, Dropbox, payment processors, hosting providers, editing services, and social media platforms.

Clear Lens Real Estate Photography does not control and cannot guarantee the availability, accuracy, processing time, policies, performance, or continued operation of third-party services.

  1. SMS AND TEXT MESSAGING TERMS

By separately opting in to text messaging, you agree to receive SMS or MMS messages from Clear Lens Real Estate Photography.

Non-marketing messages may include order confirmations, appointment reminders, scheduling updates, photographer arrival notifications, service updates, delivery notifications, payment reminders, and customer-service communications.

Marketing messages may include occasional promotions, special offers, service announcements, educational content, and Clear Lens Real Estate Photography updates. Consent to receive marketing text messages is not a condition of purchasing services.

Message frequency varies. Message and data rates may apply.

You may cancel the SMS service at any time by replying STOP to any message from Clear Lens Real Estate Photography. After sending STOP, you may receive a final message confirming that you have been unsubscribed. You will then receive no additional text messages from that messaging program unless you opt in again.

  1. EMAIL COMMUNICATIONS

By subscribing to marketing emails, you agree to receive news, service information, educational content, promotions, and offers from Clear Lens Real Estate Photography.

You may unsubscribe from marketing emails by using the unsubscribe link included in an email. We may continue sending necessary transactional or service-related emails concerning active orders, payments, account issues, or requested services.

  1. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy:

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors that provide support services, such as customer service or technology services. Text-messaging originator opt-in data and consent will not be shared with third parties.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Clear Lens Real Estate Photography will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our services, delivered media, website, or third-party platforms.

Clear Lens Real Estate Photography is not responsible for losses caused by inaccurate client information, property conditions, lack of access, weather, platform outages, missed marketing opportunities, MLS issues, delayed or undelivered communications, or unauthorized third-party use of delivered media.

To the fullest extent permitted by law, Clear Lens Real Estate Photography’s total liability relating to an order will not exceed the amount paid for the specific service giving rise to the claim.

  1. TERMINATION OF SERVICE

Clear Lens Real Estate Photography may refuse, suspend, or terminate service for nonpayment, abusive conduct, unsafe conditions, unlawful activity, repeated policy violations, misuse of media, or material violation of these Terms.

Termination does not eliminate outstanding payment obligations or restrictions on media usage.

  1. CHANGES TO THESE TERMS

Clear Lens Real Estate Photography may update these Terms periodically. Changes become effective when posted on our website with a revised effective date.

Continued use of our website or services after updated Terms are posted constitutes acceptance of the revised Terms.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Tennessee.

Any dispute arising from these Terms or the services provided by Clear Lens Real Estate Photography will be subject to the jurisdiction of the appropriate courts located in Rutherford County, Tennessee.
